Terms of Service

Overview

These Terms of Service ("Terms") govern your access to and use of the Airglitch website, applications, and related services (the "Service"), operated by Airglitch ("we", "us"). By accessing or using any part of the Service, or by creating an account or purchasing a subscription, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Our role

Airglitch is a flight search and comparison service. We display fares, schedules, and itinerary options compiled from third-party travel data providers. We do not sell, issue, or reissue tickets, and we do not process bookings.

When you choose a flight, we redirect you to the airline or travel provider, and any booking you make is made directly with that provider, under that provider's own terms and conditions and the applicable conditions of carriage. We are not a party to any contract between you and any airline or travel provider, we do not act as an agent for you or for any provider, and we have no control over and assume no responsibility for any booking, ticket, refund, change, or travel service provided by a third party. Complaints, claims, or questions regarding a booking should be directed to the provider you booked with.

Eligibility and accounts

By using the Service you represent that you are at least the age of majority in your place of residence. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it, and you agree to provide accurate and current information when creating an account or subscribing.

Fares and accuracy of information

Fares, availability, schedules, and other travel information displayed on the Service are obtained from third-party sources and change frequently. We do not guarantee that any displayed fare, availability, or schedule is accurate, complete, or current, and no price is final until the relevant provider has confirmed your booking and issued your ticket. The price at which a provider actually offers a fare may differ from the price displayed on the Service.

Occasionally information on the Service may contain typographical errors, inaccuracies, or omissions, including as to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. Estimated savings and comparisons are informational only. Any reliance on information displayed on the Service is at your own risk.

Travel documents and requirements

You are solely responsible for ensuring that you and everyone traveling with you meet all requirements for your trip, including valid passports, visas, health documentation, and entry and transit requirements for your ticketed final destination and for every point on your itinerary. You are also solely responsible for complying with the terms and conditions, fare rules, and conditions of carriage of each provider you book with, including baggage allowances and check-in requirements for each ticket. Requirements can differ for each separately booked ticket in an itinerary; verify them with the relevant provider and the relevant authorities before booking and before travel.

Subscriptions and billing

Parts of the Service require a paid subscription. Subscription fees, billing periods, and included features are described at the point of purchase. Payments are processed by our payment processor, Stripe; we do not store your full card details.

Unless stated otherwise at purchase, subscriptions renew automatically at the end of each billing period at the then-current price, and your payment method is charged at the start of each period. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by applicable law, fees already paid are non-refundable and no refunds or credits are provided for partial billing periods.

We may change subscription prices with notice to you before the change applies to your next billing period; your continued subscription after the change takes effect constitutes acceptance of the new price. Prices may be displayed in various currencies for convenience; your bank or card issuer may apply its own exchange rates and foreign transaction fees, which are outside our control and are not refundable by us.

Acceptable use

You may access and use the Service only for your own personal, non-commercial purposes. You may not, without our prior written permission: access the Service using any robot, spider, scraper, or other automated means; harvest, copy, or systematically collect fares, availability, or other data displayed on the Service; frame, mirror, resell, or redistribute any part of the Service or its data; use the Service to build or train a competing product or dataset; or circumvent any technical measure we use to protect the Service.

Prohibited uses

You may not use the Service: (a) for any unlawful purpose or in violation of any applicable law or regulation; (b) to infringe our intellectual property rights or those of others; (c) to submit false or misleading information; (d) to transmit viruses or any other malicious code; (e) to collect or track the personal information of others; (f) to spam, phish, spider, crawl, or scrape; or (g) to interfere with or circumvent the security features of the Service. We reserve the right to refuse or terminate service to anyone, and to cancel any subscription, for violation of these Terms.

Intellectual property and trademarks

The Service, including its software, design, text, graphics, and data compilations, is owned by us or our licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right in or to the Service or our trademarks.

Airline names, airline codes, airport names, and other third-party names appear on the Service solely to identify the relevant carriers, airports, and services in factual search results. All such names and any associated trademarks are the property of their respective owners. Airglitch is not affiliated with, endorsed by, or sponsored by any airline or travel provider, and no display of a third-party name on the Service implies any such relationship.

Third-party services and links

The Service contains links to third-party websites, including the airline and travel provider sites we redirect you to. These sites are not under our control, and we are not responsible for their content, policies, or practices. Review the terms and privacy policy of any third-party site before transacting with it.

Feedback

If you send us ideas, suggestions, or other feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or compensation, and we are under no obligation to keep it confidential.

Personal information

Your personal information is handled as described in our Privacy Policy.

Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that displayed fares or itineraries will be available or bookable, or that the results obtained from the Service will be accurate or reliable. We may modify, suspend, or discontinue the Service, in whole or in part, at any time without notice, and we shall not be liable to you or any third party for doing so.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Airglitch or its contractors, suppliers, service providers, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages of any kind, including lost profits, lost savings, or loss of data, arising from or relating to your use of or inability to use the Service, any booking made with a third-party provider, or any information displayed on the Service, whether based in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages. To the same extent, our aggregate liability for all claims arising from or relating to the Service shall not exceed the amounts you paid us in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, or affects statutory rights you hold as a consumer that cannot be waived by contract. In jurisdictions that do not allow certain exclusions or limitations, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Airglitch and its contractors, suppliers, service providers, and licensors from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of or access to the Service, your breach of these Terms or the documents they incorporate by reference, or your violation of any law or of the rights of a third party.

Class action waiver

To the maximum extent permitted by applicable law, you and Airglitch each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. This waiver does not apply where and to the extent prohibited by applicable law, and it does not affect mandatory consumer rights.

Termination

These Terms are effective unless and until terminated by you or us. You may stop using the Service at any time. We may suspend or terminate your access to the Service without notice if, in our reasonable judgment, you fail to comply with any provision of these Terms; you remain liable for all amounts due up to the date of termination. Provisions which by their nature should survive termination — including licenses you have granted us, disclaimers, limitations of liability, and indemnities — survive it.

Severability and waiver

If any provision of these Terms is held unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law and otherwise severed, and the remaining provisions remain in full force. Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.

Entire agreement

These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements, communications, or proposals, whether oral or written. Any ambiguity in these Terms shall not be construed against the drafting party.

Governing law and venue

These Terms and any dispute arising from or relating to them or the Service are governed by the laws of Switzerland, excluding its conflict-of-law rules. The courts at our registered seat in Switzerland have exclusive jurisdiction, except where mandatory consumer protection law grants you the right to bring or defend proceedings in another venue.

Changes to these Terms

We may update these Terms from time to time by posting the revised version on this page with an updated effective date. Material changes will be notified through the Service or by email where required. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
